These Terms of Service ("Terms") govern your access to and use of Indie Market's websites, software, mobile applications, Shopify integrations, dashboards, and related services (collectively, the "Services").
Indie Market is operated by Indie Market LLC ("Indie Market," "we," "us," or "our"). By accessing or using the Services, creating an account, connecting a Shopify store, or purchasing a subscription, you agree to these Terms.
You must be at least 18 years old and have the authority to enter into these Terms on behalf of yourself or the business you represent.
Indie Market provides tools and services that help merchants create, operate, and grow branded mobile commerce experiences. Features may include Shopify store synchronization, branded mobile applications, push notifications, campaign tools, analytics, AI-assisted features, and related services.
Features may change, be added, modified, or discontinued as the platform evolves.
Certain features require you to install Indie Market Connect and authorize access to your Shopify store. You are responsible for maintaining your Shopify account and ensuring that you have the authority to grant Indie Market access to the store and associated information.
Indie Market is an independent service and is not owned or operated by Shopify.
You agree to provide accurate information and to keep your account credentials secure. You are responsible for activity occurring through your account.
Paid Services are billed according to the pricing and subscription terms presented when you purchase your plan.
Unless otherwise stated at checkout, annual subscriptions renew according to the subscription terms disclosed at the time of purchase. Applicable taxes and third-party fees may be charged separately.
Eligible Founding Merchants may receive special pricing and benefits described in their offer. Where an offer states that Founding Merchant pricing remains locked while an annual subscription is maintained, that pricing will remain available while the qualifying subscription remains continuously active and in good standing, subject to the specific terms presented with the offer.
You retain ownership of your business names, trademarks, logos, product information, images, descriptions, and other content you provide or make available through your Shopify store.
You grant Indie Market permission to use this content as reasonably necessary to provide the Services, including creating, configuring, operating, and supporting your branded mobile application.
You may not use the Services to:
Merchants are responsible for ensuring that campaigns and communications sent through Indie Market comply with applicable laws, platform requirements, and their own obligations to their customers.
Indie Market may provide AI-assisted tools for creating campaign ideas, messaging, or other content. AI-generated output may contain errors and should be reviewed before use. You remain responsible for content you choose to publish or send.
Indie Market and its software, technology, designs, trademarks, branding, and other proprietary materials are owned by Indie Market LLC or its licensors. These Terms do not transfer ownership of Indie Market intellectual property to you.
The Services may depend on or integrate with third-party platforms and services, including Shopify, Apple, hosting providers, analytics providers, and other technology services. Indie Market is not responsible for changes, interruptions, or actions of third-party services outside our control.
We work to provide reliable Services but do not guarantee that the Services will always be uninterrupted or error-free. We may update the Services, perform maintenance, or modify features from time to time.
To the extent permitted by law, the Services are provided "as is" and "as available." Indie Market does not guarantee specific sales, revenue, conversion rates, customer retention, or other business results from using the Services.
To the maximum extent permitted by applicable law, Indie Market LLC will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Services.
You may stop using the Services according to the cancellation terms applicable to your subscription. Indie Market may suspend or terminate access when reasonably necessary for violations of these Terms, unlawful activity, nonpayment, security concerns, or misuse of the Services.
We may update these Terms as Indie Market and its Services evolve. The updated version will be posted with a revised "Last updated" date. Material changes may also be communicated through the Services or by email when appropriate.
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles.
